Pekas Smith Addresses Mental Health Disability Qualification During Mental Health Awareness Month

PHOENIX, AZ. In recognition of Mental Health Awareness Month, Pekas Smith, an Arizona disability law firm, has published guidance on how mental health conditions qualify for Social Security Disability benefits. Mental disorders account for roughly one-third of all disability allowances each year, according to the Social Security Administration (SSA), and remain one of the most frequently misunderstood categories within the agency’s Listing of Impairments.

Section 12.00 of the SSA Blue Book covers mental disorders and includes specific listings for depressive, bipolar, and related disorders; anxiety and obsessive-compulsive disorders; post-traumatic stress and other trauma-related disorders; schizophrenia spectrum and other psychotic disorders; neurocognitive disorders; intellectual disorder; autism spectrum disorder; somatic symptom and related disorders; and personality and impulse-control disorders. Each listing requires medical documentation showing both the presence of the condition (Paragraph A criteria) and either marked functional limitations across specific areas of mental functioning (Paragraph B) or a serious and persistent disorder despite ongoing treatment (Paragraph C).

The four areas of mental functioning evaluated under Paragraph B are: understanding, remembering, or applying information; interacting with others; concentrating, persisting, or maintaining pace; and adapting or managing oneself. To meet a listing, a claimant must demonstrate extreme limitation in one area or marked limitation in two areas. The SSA draws this evidence from psychiatric and psychological treatment records, function reports, and statements from third parties familiar with the claimant’s day to day functioning.

Veterans with service-connected PTSD may qualify through a combination of VA treatment records and Compensation and Pension exam documentation. Claimants whose mental health conditions do not meet a Blue Book listing may still qualify through a medical-vocational allowance, in which the SSA evaluates the combined effect of mental and physical impairments on the ability to perform past work or adjust to other work.

The firm notes that subjective symptom reporting alone is rarely sufficient. Consistent treatment, objective findings from mental status examinations, and corroborating statements from family members or employers can materially strengthen a mental health claim.
